These Terms and Conditions ("Terms") govern your access to and use of the BidX² construction estimating platform ("Service") operated by BidX² ("we", "us", or "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using BidX² you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Use of the Service
BidX² grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You agree not to:
- Resell, sublicense, or distribute the Service to third parties
- Use the Service to build a competing product or service
- Reverse engineer, decompile, or extract source code from the Service
- Use the Service in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to any systems or networks connected to the Service
3. Subscriptions & Billing
BidX² is a subscription-based service billed monthly. By providing a payment method, you authorize BidX² to charge your payment method for the applicable subscription fees on a recurring basis.
- Trial period: New accounts receive a 7-day free trial. No charge is made during the trial period.
- Billing cycle: Subscriptions renew automatically at the end of each billing period.
- Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period — you retain full access until then.
- Refunds: All fees are non-refundable except as required by applicable law.
- Price changes: We will provide at least 30 days notice of any price changes via email.
Payments are processed securely through Stripe. BidX² does not store your full payment card details.
4. Your Data
You retain full ownership of all data, estimates, and content you enter into BidX². You grant BidX² a limited license to use your data solely to provide and operate the Service. We will not sell, rent, or share your data with third parties except as described in our Privacy Policy. Upon account cancellation, you may request an export of your data within 30 days.
5. Limitation of Liability
To the maximum extent permitted by applicable law, BidX² and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits or data — arising out of or related to your use of the Service.
BidX²'s total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to BidX² in the twelve (12) months immediately preceding the claim.
